These Terms of Service ("Terms") constitute a legally binding agreement between you and Helios Frontier LLC ("Company," "we," "us," or "our") concerning your access to and use of the Project Nova™ platform, including our website, mobile applications, and all related services (collectively, the "Service").
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.
2.1 Children Under 13: Project Nova™ is designed for children in grades K-5 (ages 5-11). In compliance with the Children's Online Privacy Protection Act (COPPA), we require verifiable parental consent before collecting personal information from children under 13 years of age.
2.2 Parental Responsibility: Parents and legal guardians are responsible for monitoring their child's use of the Service and ensuring appropriate usage. By providing consent, you acknowledge that you are the parent or legal guardian of the child using the Service.
2.3 Homeschool Families: Project Nova™ is designed exclusively for homeschool families. Parents create and manage all accounts for their children.
Federal Law Compliance
In compliance with federal law, Project Nova™ recognizes only two genders: male and female.
3.1 Gender Recognition Policy: Our AI chat system is programmed to recognize and use only male and female gender classifications, with corresponding pronouns he/him for boys and she/her for girls.
3.2 Content Filtering: Questions or discussions about gender identity topics beyond male and female are automatically redirected to parents or teachers, as these topics are outside the scope of our educational platform and require parental guidance.
3.3 Parental Authority: We recognize that discussions about gender, identity, and related topics are the responsibility and right of parents and guardians. Our platform defers all such discussions to parents and does not provide guidance on these matters.
3.4 Educational Focus: Project Nova™ focuses exclusively on academic subjects including mathematics, science, reading, writing, history, geography, and other educational topics appropriate for homeschool children in grades K-5 (ages 5-11).

Project Nova™ uses artificial intelligence (AI) to generate educational content and conversations. While we implement extensive safety measures, AI systems can occasionally produce unexpected or inappropriate responses.

6.1 Account Creation: To use certain features of the Service, you must create an account. You agree to provide accurate, current, and complete information during registration.

6.3 Account Types: We offer different account types (Child, Parent, Administrator) with varying access levels and permissions appropriate to each role.
7.1 Free Trial: We offer a 3-day free trial with access to limited features. No credit card is required for the trial period.

9.1 Company Property: The Service, including all content, features, functionality, software, AI characters, games, and educational materials, is owned by Helios Frontier LLC and protected by copyright, trademark, and other intellectual property laws.
8.2 Trademarks: Project Nova™ and all character names (Kiko™, Sprocket™, Lyra™, Axel™, G.O.™, Bloom™, Orion™, Misty™, Barnaby™, Coral™) are trademarks of Helios Frontier LLC.
9.2 User Content: You retain ownership of any content you submit to the Service. By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, and display such content for the purpose of operating and improving the Service.
10.1 AI-Related Harm: Notwithstanding Section 3.2, our total liability for any claims arising from AI-generated content shall not exceed the greater of: (a) $10,000 per incident, or (b) the total amount paid by you to us in the 12 months preceding the incident.
10.2 General Limitation: TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL HELIOS FRONTIER LLC BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.
9.3 Exceptions: Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability shall be limited to the fullest extent permitted by law.
11.1 Governing Law: These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.
11.2 International Users: If you access the Service from outside the United States, you do so at your own risk and are responsible for compliance with local laws. We make no representation that the Service is appropriate or available for use in other locations.
11.3 Compliance with Local Laws: In addition to these Terms, users must comply with all applicable local, state, national, and international laws and regulations, including but not limited to:

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on our website and updating the "Last Updated" date.
Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms. If you do not agree to the new Terms, you must stop using the Service.
